Terms of Service

Version 2.3, updated 4 November 2026. Effective 20 September 2026 for plans bought from that date. Previous version

1. Who we are

GetClipMachine is operated by GT, established in Malta, VAT number MT 27616023, at Binja Buqana BLK B, Clocktower Street, Mtarfa, Malta. You can reach us at support@getclipmachine.com or through the form at getclipmachine.com/contact.

In these terms, “we”, “us” and “our” mean GT. “You” means the person or business that opens an account.

2. What these terms cover

These terms are the agreement between you and us for your use of getclipmachine.com and everything we provide through it (the “Service”). You accept them when you create an account or buy a plan. If you do not accept them, do not use the Service.

When these terms start to apply. They apply from 19 September 2026 to every new account and to every plan bought on or after that date. If you already had a paid plan before that date, the previous terms keep applying to it until 19 October 2026, and you may cancel before then. The exception is clauses 9 and 10: they only improve your position, so they apply to every customer from 19 September 2026, whenever the plan was bought. Clause 18.2 applies to anything already under way.

Version 2.1. From 20 September 2026 our checkout asks every buyer how they are buying (clause 5.2) and for the two confirmations described in clause 9.3. That changes what a withdrawal costs only for plans bought on or after that date, and only where the checkout actually asked for both confirmations. For any plan bought earlier, or bought without them, nothing is deducted from a withdrawal refund, exactly as clause 9.4 says.

3. The Service

3.1

The Service takes long-form video you supply, by upload or by link, and produces shorter vertical clips from it with captions, together with an automated score estimating likely engagement.

3.2

Clip selection, transcription, captions, framing, cropping and scoring are performed by automated systems. Output quality varies with the source material and may contain errors, so review clips before you publish them. The score is an estimate produced by software. It is not a prediction, a guarantee of performance, or advice.

3.3

We develop the Service continuously and may add, change or remove features. Where a change materially reduces what your paid plan provides, clause 18 applies.

4. Accounts

4.1

You must be at least 18 and legally able to enter into a contract.

4.2

Keep your login details secure. You are responsible for activity on your account.

4.3

One account per person or business. You may not share, sublicense or resell access without our written agreement.

4.4

Give us accurate registration details and keep them current.

5. Consumer or business

5.1

A consumer is an individual acting for purposes outside any trade, business, craft or profession. We treat every customer as a consumer unless clause 5.2 applies, so clauses 9 and 10 apply to you in full by default.

5.2

When you buy a plan, the checkout asks whether you are buying as an individual (consumer) or for a business. If it is for a business, it asks for your VAT number or business registration number. You can also give us that number later by emailing support@getclipmachine.com.

We do not verify that number automatically, and stating that you are a business does not by itself make you one under these terms. Once we have verified the number and confirmed in writing that your plan is a business plan, you are a business customer. Until then we treat you as a consumer. Business customers are not consumers. The rights in clause 9 and the consumer protections in clauses 10 and 15.4 do not apply to them, and business purchases are non-refundable except as clause 16 provides.

5.3

The basis on which you buy is the basis on which we contract with you, price the Service and account for VAT. Tell us if it changes.

6. Plans

6.1

Free plan. 3 videos per calendar month, each up to 45 minutes and 4 GB, output watermarked, no payment and no minimum term. The free plan is there so you can judge whether the Service suits you before you pay for it.

6.2

Pro plan. A flat fee for a stated period, monthly or yearly. While it is active there is no monthly limit on the number of videos, output carries no watermark, and each video may be up to 180 minutes and 4 GB. The current price and what it includes are shown on our pricing page and again before you pay. A Pro plan started before 4 November 2026 also includes 4K export, for as long as that subscription continues.

6.3

A video counts towards a plan's limits when the Service begins processing it. Output you consider unsatisfactory, poorly framed or low-scoring still counts, because the processing has been carried out.

6.4

“No monthly limit” on Pro is for one person or business clipping material they own or have permission to clip, through the Studio. It does not cover automated or bulk use that places unreasonable load on the Service (clause 13).

6.5

Max plan. A flat fee for a stated period, monthly or yearly, with everything in Pro, and: 4K export is available; each video may be up to 6 hours and 4 GB; several links can be started at once in the Studio; the account can keep more than one brand profile for the Framed layout; and up to 240 hours of video can be processed in each calendar month (UTC), counted by the length of each video. Videos that fail do not count. Once the month's hours are used, new videos can be started again from the first day of the next month; videos already being processed are finished. The current price and what it includes are shown on our pricing page and again before you pay.

7. Payment and renewal

7.1

Fees are charged in advance for each period through our payment provider, Stripe. The price shown at checkout is the total you pay, including VAT where it applies. Nothing is added to it afterwards. If you pay in a currency other than the one the plan is priced in, the checkout shows the converted amount and any conversion fee before you pay.

7.2

Plans renew automatically at the end of each period until cancelled. For any period longer than one month we email you a reminder before renewal, telling you the date and the amount.

7.3

We may change prices on at least 30 days' notice by email, taking effect at your next renewal. You may cancel before then.

7.4

Promotional and launch pricing applies only to the period stated in your order. Renewals are charged at the standard rate then in force unless we say otherwise in writing.

8. Cancellation and what happens to your access

8.1

You can cancel at any time from your account settings, or by emailing us.

8.2

Where you cancel an ongoing plan and are not exercising a withdrawal right under clause 9, cancellation stops the next renewal. Your paid access runs to the end of the period you have already paid for, and no refund is due for that remaining time except where the law requires one.

8.3

Where you withdraw under clause 9, or where we agree a refund with you for any reason, your paid access ends on the date that withdrawal or agreement takes effect. On that date we cancel the plan and the account returns to the free plan. Download any unwatermarked or 4K exports you need before then.

8.4

Use of paid features after that date is not covered by any plan. We may charge for it at the daily rate of the plan you held, for each day on which paid features were used, and set that off against any refund owed to you. If we do that, we will tell you the amount and identify the jobs it relates to.

8.5

Clause 8.4 does not apply where we failed to end the paid access within a reasonable time of the date in clause 8.3 and you had no way of knowing it had ended.

9. EU right of withdrawal

9.1

If you are a consumer resident in the EU, you may withdraw from a paid plan within 14 days of the day the contract was concluded, without giving a reason.

9.2

To withdraw, tell us clearly before those 14 days expire. Email support@getclipmachine.com from your account address, or write to us through getclipmachine.com/contact. Any clear statement of your decision is enough; you do not need a form or a reason.

9.3

Starting immediately. Before you pay, our checkout asks you for two separate confirmations, neither of them ticked in advance: that you are asking us to start your plan straight away, during the 14-day withdrawal period, and that you understand that if you then withdraw you pay for the days you have had. We record both, and we repeat them to you in the email that confirms your plan.

Without both confirmations we do not start a paid plan during the 14 days. If you would rather your plan started once the 14 days have passed, write to us through getclipmachine.com/contact before you pay and we will arrange that instead. Paid access otherwise begins as soon as your payment succeeds. Using it during the 14 days does not take away your right to withdraw.

9.4

What you get back. We may only keep part of the fee if, before your access started, you expressly asked us to start during the withdrawal period and acknowledged that this amount would be payable, which is what the two confirmations in clause 9.3 are. If you bought before our checkout asked for them, or for any reason you were not asked, nothing is deducted and we refund the full amount you paid for the plan.

Where you gave both confirmations, we keep a proportionate amount and refund the rest. The amount we keep is the price you paid, multiplied by the number of days of paid access you had, from the start of your plan to the moment you told us you were withdrawing, divided by the number of days in the period you paid for. It is rounded in your favour: only complete days are counted, and the amount we keep is rounded down to the cent. For example, withdrawing after 5 complete days of a 30-day period bought for €15 means we keep €2.50 and refund €12.50.

9.5

When you get your money. We refund what is due within 14 days of the day you tell us you are withdrawing, to the payment method you used, at no cost to you. This does not depend on when our payment provider settles funds to us.

9.6

This clause does not apply to business customers under clause 5.2.

10. If something is wrong with the Service

10.1

Separately from clause 9, if the Service is faulty, does not match how we described it, or is not supplied, consumers have rights under Directive (EU) 2019/770 as implemented in Malta and in your country of residence. You are entitled to have the problem put right, and if we cannot, to a price reduction or to end the contract and be refunded.

10.2

These rights cannot be excluded or limited and nothing in these terms attempts to.

10.3

For clarity, dissatisfaction with which moments the Service selected, how it framed them, or what score it gave them is not by itself a fault, given clause 3.2. A Service that does not do what we said it does is.

11. Your content

11.1

You keep ownership of the video you supply and of the clips the Service produces from it.

11.2

You grant us a limited, non-exclusive licence to store, process, transmit and display your content solely to provide the Service to you and to keep it secure. The licence ends when the content is deleted.

11.3

Your source videos and clips stay in your account for as long as it is open, so that you can re-render and re-export them. You can ask us to delete any of them at any time by emailing us. When your account is closed we delete all remaining content within 30 days, apart from records we are required to keep for longer by law, such as billing records.

11.4

We do not use your content to train models.

11.5

To operate the Service we pass your content to the processors listed in our Privacy Policy (hosting and storage, speech transcription, AI clip selection), only so far as the Service needs it.

12. Rights in what you upload

12.1

You must own the rights to every video you upload or import, or have permission from the person who does.

12.2

You are solely responsible for whether your use of the output infringes anyone's rights, including where the source video was made by someone else, and for following the rules of the platforms you import from and publish to.

12.3

You will cover us for any claim brought against us because of content you uploaded or published. For consumers, this applies only where the claim results from your deliberate or negligent breach of 12.1.

12.4

On a credible rights complaint we may remove content and suspend the account it came from.

13. Acceptable use

You may not use the Service to produce, process or distribute material that:

  • infringes anyone's intellectual property or privacy rights;
  • is unlawful in Malta or in your own country;
  • harasses, threatens or defames a person;
  • promotes hatred against, or degrades, a person or group by reference to race, ethnicity, national origin, religion, disability, sex, sexual orientation or gender identity;
  • sexualises a minor in any way;
  • depicts or promotes serious violence or terrorism;
  • is deceptive, including impersonation and fabricated material presented as real.

You also may not reverse-engineer the Service, attempt unauthorised access, upload malicious code, or run automated processes that place unreasonable load on it.

We decide, acting reasonably, whether material falls within this clause. We may remove content and suspend or terminate accounts for a breach, and we may do so without refund where the breach is serious or repeated.

14. Availability

14.1

We aim to keep the Service available but do not promise uninterrupted access. We may suspend it for maintenance, and will give notice where we reasonably can.

14.2

Except as clause 10 provides, the Service is provided as is. We do not warrant that output will reach any particular standard, score, reach or audience.

15. Liability

15.1

Nothing here limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law, including consumers' rights under clause 10.

15.2

Subject to 15.1, our total liability for all claims connected to the Service is limited to what you paid us in the three months before the claim arose.

15.3

Subject to 15.1, we are not liable for lost profit, lost revenue, lost audience or lost content, or for indirect or consequential loss.

15.4

If you are a consumer, 15.2 and 15.3 apply only so far as the consumer law of your country of residence allows.

16. Termination by us

16.1

We may suspend or terminate your account for breach of these terms, for non-payment, or where the law requires it.

16.2

Where we terminate for a reason other than your breach, we refund the unused part of the fee for your current period.

16.3

Clauses 11.1, 12, 15, 17 and 19 survive termination.

17. Data protection

We process personal data as controller under the GDPR and Maltese data protection law. What we collect, why, how long we keep it and how to exercise your rights are set out in our Privacy Policy. Questions and requests go to support@getclipmachine.com.

18. Changes to these terms

18.1

We may change these terms. For changes that materially affect you we give at least 30 days' notice by email, and you may cancel before they take effect.

18.2

Changes never apply retroactively to a withdrawal, refund or complaint already under way.

19. Law and disputes

19.1

Maltese law governs these terms and the Maltese courts have jurisdiction.

19.2

If you are a consumer, 19.1 does not take away the protection of the mandatory law of your country of residence, and you may bring proceedings in your own country's courts.

19.3

Please contact us first, because most problems can be settled quickly. You may also raise a complaint with the Malta Competition and Consumer Affairs Authority (mccaa.org.mt), or, if you live in another EU country, ask the European Consumer Centre in your country for help.
